A proposed class action was filed against Wellness International Network, Ltd. (which the suit notes was formerly known as Physicians’ Health & Diet Program, LLC) after it allegedly sent an illegal fax advertisement to a Florida chiropractor. Citing potential Telephone Consumer Protection Act violations, the complaint claims the defendant faxed “at least one advertisement” to the plaintiff without his prior consent and failed to include the required “opt-out” language informing him of his right to avoid receiving future faxes.
