Trucker Sues ITG Insurance, Others Over Unsolicited Text Message Advertisements

ITG Insurance Agency LLC, Independent Truckers Group, and Hallmark Financial Services, Inc. are facing claims that they violated the Telephone Consumer Protection Act by sending unsolicited text message advertisements to consumers’ cell phones.

ITG Insurance Agency LLC, Independent Truckers Group, and Hallmark Financial Services, Inc. are facing claims that they violated the Telephone Consumer Protection Act by sending unsolicited text message advertisements to consumers’ cell phones. The plaintiff, a trucker who lives in Florida, says he received a text message from the defendants that read:
“Hate the high price of Obama Care? Call for a free $250 rewards card and free healthcare quote. TRUCKER plans start less than $59 a month. 214-396-6822.”
After calling the number in the message, the plaintiff asked the representative how the defendants’ got his phone number, and the call was immediately terminated, according to the complaint. “Accordingly,” he surmises, “it appears that [the defendants] know that their text message campaign is illegal.”
The suit alleges the defendants work together to sell insurance to truckers and have most likely sent the same illegal text message to thousands of others, invading their privacy and causing them to incur costs from their cell phone providers.
