Northland Group, Inc. has been named as the defendant in a proposed class action lawsuit that alleges violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff claims the debt collector sent her a collection letter that contained the following sentence: “As of the date of this letter, the balance due on the account is $2,347.31. Because of adjustments that may vary from day to day, the amount due on this account may be different after the date of this letter.” The suit argues that this statement is misleading because the defendant is not authorized to add additional fees to the plaintiff’s account balance. Furthermore, the letter purportedly violates the FDCPA in that it fails to clearly communicate the amount of the plaintiff’s alleged debt by indicating that the amount “may be different” each day. The suit claims the defendant “arbitrarily threatened” the plaintiff with the misleading statement to induce her into paying the debt as soon as possible.
