A Florida chiropractor’s office has filed suit against defendant Stymco Technologies, LLC, claiming that the company sent unsolicited fax advertisements that violated an amendment of the Telephone Consumer Protection Act. The faxes allegedly contained information about Stymco’s goods and services and neglected to include the required opt-out language providing the recipient with a right to decline future faxed advertisements. According to the complaint, the defendant never received prior consent to send the faxes and unlawfully consumed the plaintiff’s time and resources.
