A blind man has filed a lawsuit in Florida against Sergio’s Restaurant No. 6, LLC, claiming the restaurant’s website contains numerous access barriers that prevent blind individuals from taking advantage of the goods and services it offers. The plaintiff says he attempted to access the website on several occasions using his screen reading software, but that multiple sections of the website were “unreadable.” Without the use of alternative text to describe graphics and images, blind people are unable to use their keyboards to navigate the site and complete transactions, the suit argues.
According to the complaint, Sergio’s has discriminated against the plaintiff in that “[the plaintiff] has been denied full and equal access to Sergios.com, has not been provided services which are provided to other patrons who are not disabled, and has been provided services that are inferior to the services provided to non-disabled persons.”
