RTI International is on the receiving end of a proposed class action lawsuit filed by a West Virginia resident who claims the company placed two illegal telemarketing calls to her cell phone without her prior consent. According to the complaint, the defendant, which the suit notes does business as Research Triangle Institute, called the plaintiff to notify her that she had been “chosen randomly” to receive a gift card for participating in a survey. The plaintiff says the defendant’s representative informed her that her number had been dialed by a computer that was “linked to a whole bunch of numbers.” The suit argues that the company had used autodialing technology to engage in a “broad telephone campaign” and illegally called consumers without first obtaining consent to do so, an alleged violation of the Telephone Consumer Protection Act (TCPA).
