Two New York consumers are the named plaintiffs in a proposed class action alleging Paul Michael Associates sent out collection notices that violated the FDCPA.
Two New York consumers are the named plaintiffs in a proposed class action alleging Paul Michael Associates sent out collection notices containing Fair Debt Collection Practices Act (FDCPA) violations. Both plaintiffs claim they received notices from the defendant that, while identifying Paul Michael Associates as the collector, failed to note the name of the original creditor to whom their debts were owed as required by the FDCPA.
“Merely naming the creditor without specifically identifying the entity as the current creditor to whom the debt is owed is not sufficient to comply with the FDCPA,” the lawsuit argues.
