A settlement has been reached to resolve a proposed class action lawsuit that alleged Oak Valley Hospital failed to prevent a 2023 data breach, which reportedly impacted the personal information of hundreds of thousands of patients.

The class action settlement, which was granted preliminary approval by the court on July 16, 2024, covers an estimated 268,267 United States residents who received a notice from Oak Valley or its authorized representative about the data security incident that occurred between April 21 and July 18, 2023.
To receive an Oak Valley settlement payout, eligible class members must file a valid claim form online or by mail by November 19, 2024.

In order to file a claim online, you will need the unique Notice ID and Confirmation Code found on the personalized settlement notice you should have received via mail or email, the website shares.
According to the Oak Valley settlement website, class members who file a timely, valid claim may be eligible to receive a $100 cash payout.
In addition, class members can file a claim for reimbursement of documented out-of-pocket expenses that have not been reimbursed previously by a third party and are “fairly traceable” to the data breach, for up to $5,000 per person, the site relays.
Moreover, consumers may also make a claim for up to three hours of lost time spent handling issues related to the incident, at a rate of $30 per hour, the website says.
Per the site, all cash payments will be subject to pro rata increase or decrease based on the total number of valid claims that are filed.
Finally, as part of the deal, Oak Valley has also agreed to enhance its cybersecurity to better protect its data network in response to the breach, the website adds.
Oak Valley settlement payouts will be distributed to eligible class members after the deal is granted final approval by the court at a hearing set for December 19, 2024. The final approval process may be prolonged by appeals that must be resolved before settlement rebates are issued to qualifying consumers, the site explains.
The class action lawsuit claimed Oak Valley was responsible for the heightened and ongoing risk of identity theft that data breach victims now face as a result of the 2023 cyberattack. The suit contended that the incident, which involved unauthorized access to files containing private patient information, compromised individuals’ names, Social Security numbers, health insurance data, medical care details and other sensitive information.
