The Crystal Geyser bottled water lawsuit detailed on this page was voluntarily dismissed without prejudice by the plaintiff on April 25, 2024.
The three-page notice of voluntary dismissal for the microplastics lawsuit states no reason as to why the plaintiff opted to drop the case.
A day prior to the voluntary dismissal, United States District Judge Michael W. Fitzgerald declined a request to transfer the case to a court handling a similar suit, reasoning that although the lawsuits “implicate nearly identical legal issues, they involve different products, different defendants, and unrelated plaintiffs who suffered separate and distinct injuries.”

The 16-page lawsuit claims that defendant CG Roxane, LLC has misled shoppers by intentionally marketing its bottled water as “natural” despite being aware that the products are contaminated with microscopic plastic particles. The suit says microplastics can seep into the water during the bottling or manufacturing process, or as the container deteriorates.
The microplastics lawsuit contends that Crystal Geyser’s packaging is misleading because the contaminants found in the water are hardly “natural.” In fact, microplastics are typically made from polypropylene, polyethylene, polystyrene and other synthetic substances, the complaint relays.
The lawsuit comes in the wake of similar cases filed against major brands after recent studies revealed widespread microplastic contamination in several bottled water products. Per the suit, a 2018 study showed that 93 percent of the tested samples—259 individual bottles across 11 brands—were contaminated with plastic fragments.
According to the filing, once microplastics are absorbed or ingested, they can be transported through the circulatory system—along with any other environmental pollutants they may carry—and build up in the gut and other organs. Chronic exposure to microplastics may lead to gastrointestinal and cardiovascular issues, hormone imbalances and reproductive complications, the complaint explains.
The case charges that the misleading labeling of Crystal Geyser bottled water has consequences for the environment and consumer health at large.
The suit emphasizes that “copious research has shown the deleterious effects of plastic bottles on both the environment and human health, yet [CG Roxane] continues to bottle its water in plastic and continues to label the Products as Natural.”
The lawsuit looks to represent anyone in the United States who purchased Crystal Geyser bottled water at any time in the past four years.
