Mulkay Cardiology Consultants has agreed to settle a proposed class action lawsuit filed over a September 2023 data breach reportedly exposed current and former patients’ private information to unauthorized parties.

The class action settlement covers 79,852 people in the United States who were impacted by the Mulkay Cardiology Consultants data breach that occurred between September 1 and September 5, 2023, including all who were sent a notice of the incident.

To receive a Mulkay Cardiology Consultants settlement payout, eligible class members must file a valid claim form online or by mail by February 22, 2025.

Settlement class members can submit a claim for reimbursement for documented out-of-pocket expenses incurred as a result of the data breach, as well as for up to three hours of lost time spent dealing with the incident, at a rate of $25 per hour. Claims for out-of-pocket expenses and lost time will be capped at $500 per claimant, the settlement website shares.
Covered individuals can also file a claim to get up to $5,000 for documented “extraordinary” losses from actual identity theft that occurred between September 1, 2023 and October 25, 2024 and was fairly traceable to the Mulkay Cardiology Consultants data breach.
In the alternative to the benefits mentioned above, class members can submit a claim for a $48 cash payment.
Class members who file a claim will also be eligible to receive two years of credit monitoring and insurance services at no cost.
The Mulkay Cardiology Consultants data breach settlement was preliminarily approved by the court in October 2024. The parties now await a hearing set for April 11, 2025, at which the court will decide whether to grant final approval to the terms of the deal.
“Settlement benefits will be distributed if the Court grants final approval of the Settlement and after any appeals are resolved, or after the period to seek an appeal has expired,” the settlement site says.
A consolidated complaint was filed against Mulkay Cardiology Consultants at Holy Name Medical Center, P.C. and Mulkay Cardiology Consultants, P.C. in February 2024. The lawsuit claimed the defendants’ alleged cybersecurity negligence led to the exposure of patients’ names, addresses, dates of birth, Social Security numbers, driver’s license numbers or state IDs, medical treatment information and health insurance information.
