The organizers of the now-infamous Fyre Festival are the defendants in yet another proposed class action lawsuit filed by would-be attendees who allege they were sold tickets to an purportedly luxury event that “fell woefully short of what was advertised in virtually every way.”
Calling the failed luxury music festival a “calamity” and a “slow-motion fiasco,” the 37-page lawsuit out of Florida claims defendants Billy McFarland, Jeffrey Atkins (a/k/a Ja Rule), Fyre Festival, LLC, and promotion and marketing groups 42West, LLC and Matte Projects, LLC not only knew well in advance that Fyre Festival was dangerously under-equipped, but still have not refunded attendees who, despite being promised an all-inclusive, cashless experience, were forced to make their own arrangements to find food and travel home.
“As a result, thousands of ticketholders in route to the vacation of a lifetime found themselves stranded when the event was abruptly cancelled due to inadequate preparation,” the lawsuit alleges. “Not only did ticketholders shell out thousands of dollars to purchase tickets to the event, but in order to attend the event, then were required to make transportation arrangements to Miami, where festivalgoers would then board a flight to the purported private island in the Exumas. Once the event was abruptly cancelled, ticketholders were left to fend for themselves.”
This latest lawsuit was filed by two North Carolina consumers and seeks more than $5,000,000 in damages on behalf of proposed class members.
