The 27-page lawsuit was filed after the Wisconsin-based producer announced a voluntary recall on September 6 of all carton sizes and types of Milo’s Poultry Farms-brand eggs, all carton sizes of Tony’s Fresh Market-brand eggs and all cases of eggs for retail foodservice distribution. The product recall, which includes eggs of all expiration dates, was initiated by the U.S. Food and Drug Administration after certain samples tested positive for salmonella, a type of harmful bacteria that can cause a serious intestinal infection called salmonellosis, the case says.
As of October 17 of this year, the Centers for Disease Control and Prevention reports 93 cases of infection and 34 hospitalizations linked to the Milo’s Poultry Farms salmonella outbreak.
According to the class action suit, symptoms of salmonellosis—which include diarrhea, stomach cramps, fever, nausea, vomiting, headache, chills and bloody stool—typically start between six hours and six days after infection and usually last between four and seven days.
The lawsuit against Milo’s Poultry Farms claims the producer has failed to alert consumers that its eggs may be contaminated with salmonella, as there is no warning on product packaging about the possible presence of the bacteria.
The complaint contends that consumers expect the food products they buy to be safe and would not have purchased the eggs at issue had they known of the risk of salmonella exposure.
The lawsuit looks to represent anyone in the United States who purchased the recalled Milo’s Poultry Farms-brand eggs, any carton size of Tony’s Fresh Market-brand eggs and any case of the eggs for retail foodservice distribution with any expiration date.
