Medguard Alert, Inc. is on the receiving end of a proposed class action lawsuit that claims the company violated federal law in placing “thousands” of telemarketing phone calls to consumers’ cell phones without consent.

The plaintiff alleges he received a call from the defendant on May 11, 2018, that greeted him with a pre-recorded voice attempting to sell him Medguard’s medical alert product. In an attempt to identify the company behind the call, the plaintiff reportedly ordered a medical alert system from the defendant, at which time he learned he also would have to agree to pay $29.95 per month for medical alert monitoring services.
Prior to receiving the call, which was supposedly placed using autodialing technology, the plaintiff had never done any business with the defendant and never provided consent to receive marketing calls, the suit says.
The case claims the plaintiff “suffered concrete harm” as a result of the defendant’s potentially illegal telemarketing practice, including invasion of privacy and a waste of his resources.
