A Florida man has filed suit against Hibbett Sporting Goods, Inc. over alleged Telephone Consumer Protection Act (TCPA) violations.
A Florida man has filed suit against Hibbett Sporting Goods, Inc. over alleged Telephone Consumer Protection Act (TCPA) violations. The complaint claims the plaintiff sent a text message to the defendant in order to receive a 10 percent discount off a purchase in its retail store. He then received a text containing the discount, according to the suit, and allegedly continued to receive text messages over the next two years advertising coupons for the defendant’s products. The plaintiff argues that he never provided Hibbett Sporting Goods with his written consent to receive text message advertisements and claims that the 10 texts he received, including the original discount text, were illegal under the TCPA.
