A proposed class action has been filed against Macy’s, Inc. after the retailer allegedly sent unwanted text message advertisements to a consumer’s cell phone and ignored his requests to no longer receive them.
A proposed class action has been filed against Macy’s, Inc. after the retailer allegedly sent unwanted text message advertisements to a consumer’s cell phone. The plaintiff says he was visiting Macy’s website when he came across an image informing him he could receive 25 percent off his next order by texting the provided number. After doing so, the man received a special discount code, the case alleges, but the code didn’t apply to his purchase. Over the next few days, the complaint continues, the plaintiff received several marketing text messages from the defendant, even after following the messages’ opt-out instructions. Despite responding to the texts with “STOP” multiple times, the plaintiff received four more unsolicited text messages in violation of the Telephone Consumer Protection Act, the suit claims.
