Clayton v. EGS Financial Care, Inc.
Filed: April 3, 2017 ◆§ 1:17-cv-00473-DAD-JLT
EGS Financial Care, Inc. is the defendant in a lawsuit filed by a California man who alleges that the debt collector violated the Telephone Consumer Protection Act.
EGS Financial Care, Inc. is the defendant in a proposed class action filed by a California man who alleges that the debt collector violated the Telephone Consumer Protection Act with the “frequent and incessant calls” it made through an automated telephone dialing system. The plaintiff claims he never provided his telephone number to the defendant “for any purpose whatsoever” or consented to receiving the automated calls. He further argues that the unwanted calls are an invasion of his privacy and that he is charged for them by his cellular service. According to the complaint, the proposed class includes:
“All persons within the United States who received any collection telephone calls from Defendant to said person’s cellular telephone made through the use of any automatic telephone dialing system and such person had not previously consented to receiving such calls within the four years prior to the filing of this Complaint.”
