A Houston resident claims she received unsolicited text messages from iCan Benefit Group advertising the company's services.
A Houston resident alleges in a proposed class action that defendant iCan Benefit Group LLC sent her an unsolicited advertisement text message in violation of the Telephone Consumer Protection Act (TCPA). The plaintiff claims she received a text from the defendant in which the company advertised its insurance services. The case charges that the message was sent via an automatic telephone dialing system, the use of which in non-emergency situations is significantly restricted under the TCPA. Moreover, the plaintiff says her cell phone number has been in the National Do-Not-Call Registry since around January 2005.
