The 19-page lawsuit alleges that contrary to the packaging’s “unequivocal” representation that the Great Value product contains pure avocado oil as the only ingredient, independent testing has shown that the item is, in fact, “adulterated with other oils.”
The suit contends that the avocado oil-only representations mislead reasonable consumers into believing the item is made with only pure, unadulterated avocado oil, which is regarded as one of the healthiest cooking oils. Per the case, research has linked the consumption of avocado oil to improved heart health and reduced blood pressure, cholesterol and joint pain.
However, the complaint charges that, “[r]egardless of whether consumers believe avocado oil is in fact superior to other oils, the issue of whether the cooking oil is pure is material to reasonable consumers.”
The filing points out that shoppers may be allergic to certain oils, or have a variety of other reasons for avoiding specific ingredients.
“Simply put, consumers of the [Great Value avocado oil] reasonably expect to know what type of oil they are consuming,” the suit asserts.
As the case tells it, Walmart customers would not have paid as much for the product, or purchased it at all, had they known it did not contain pure avocado oil.
The lawsuit looks to represent anyone who purchased at least one bottle of Great Value avocado oil in California within the applicable statute of limitations period.
