Alec Mitchell is the defendant in a proposed class action filed by a plaintiff who claims he received unlawful junk faxes from the car buyer and reseller that did not include legally required opt-out language. According to the complaint, the plaintiff received a fax advertisement from the defendant in early April 2018 detailing Mitchell’s services in purchasing trucks, cargo vans, and sprinters. The lawsuit claims the defendant’s failure to include a means for recipients to opt out of receiving future faxes violates the federal Telephone Consumer Protection Act (TCPA).
