Eggland’s Best Lawsuit Says Eggs With ‘25% Less Saturated Fat’ Are Mislabeled

A proposed class action alleges the “25% Less Saturated Fat than Regular Eggs” claim on packages of Eggland’s Best eggs is false and that lab testing has revealed that the eggs actually contain higher levels of saturated fat than their “regular” counterparts.

The 20-page Eggland’s Best lawsuit accuses the company of having misled consumers by falsely labeling packages of eggs as containing less saturated fat than “regular” eggs, when the products allegedly contain more than twice the amount of saturated fat. The case claims Eggland’s Best, the second-largest egg producer in the United States, has been able to sell more of its products at higher prices, and take market share away from competitors, by misrepresenting the “true nature and quality” of the products.
“Even today, members of the Proposed Class are purchasing the misrepresented Products, and they will continue to do so unless Eggland’s Best’s conduct is stopped,” the suit alleges.
According to the complaint, testing conducted by Anresco Laboratories in August 2023 found that Eggland’s Best’s online saturated fat claims “do not comport with the actual nutritional value of the Products.” The testing, commissioned by the plaintiff’s counsel, found that although Eggland’s Best states that the eggs at issue contain only one gram of saturated fat, as opposed to 1.5 grams in other eggs, the defendant’s products in truth have 2.84 grams of saturated fat per serving, the lawsuit says.
“This testing demonstrates that Eggland’s Best has misrepresented that the Products contain less saturated fat than other eggs,” the suit summarizes. “According to the testing, the Products contain more saturated fat than other eggs.”
No reasonable consumer would interpret the “25% Less Saturated Fat than Regular Eggs” claim to mean Eggland’s Best eggs contain more saturated fat, the case continues. The filing accuses Eggland’s Best of intentionally misrepresenting the eggs, namely because consumers are willing to, and do, pay more for products they believe are healthier.
The lawsuit looks to cover all consumers who bought Eggland’s Best shell egg products labeled as containing “25% Less Saturated Fat than Regular Eggs” in California during the applicable statute of limitations period.
