Florida
A Florida man has filed a proposed class action against Diversified Recovery Bureau in which he claims the collection agency has placed thousands of calls to consumers’ cell phones without first obtaining consent to do so or confirming the individual being called is in fact the right person. The plaintiff alleges he received at least two prerecorded calls from the defendant in early May 2018 concerning a debt owed by an unrelated individual. Diversified Recovery Bureau not only failed to obtain from the plaintiff express consent to communicate by way of prerecorded messages, the lawsuit claims, but also placed the calls through an automatic telephone dialing system.
“Upon information and belief, [the defendant] utilizes pre-recorded calls to third-party individuals in order to locate individuals it is trying to collect unpaid debts from,” the case claims.
