Court Preliminarily Approves $750K Mondelez, BCLP Settlement, Resolving Data Breach Lawsuits

A proposed class action lawsuit claims Mondelēz Global failed to protect the personal information of more than 51,000 employees during a February 2023 cyberattack.
Mondelēz Global LLC and Bryan Cave Leighton Paisner LLP (BCLP) have agreed to pay a $750,000 settlement to resolve several consolidated class action lawsuits over a February 2023 data breach that compromised the personal information of more than 53,000 people.

The Mondelēz and BCLP class action settlement was granted preliminary approval by the court on October 10, 2024. According to the 10-page approval order issued by United States District Judge Jorge L. Alonso, the deal covers anyone who was sent notice by BCLP and clients Mondelēz and Chicago IVF that their personally identifiable information or protected health data was or may have been compromised in the data security incident, which reportedly occurred between February 23 and March 1, 2023.
The number of class members is estimated to be 53,252 people, the settlement agreement says.
Court records indicate that the plaintiffs filed an unopposed motion and memo detailing the terms of the deal on October 4, 2024. If the Mondelēz and BCLP data breach settlement is granted final approval by the court following a hearing set for January 21, 2025, the companies will pay $750,000 to be distributed among class members who submit a timely, valid claim.

Per the settlement agreement, eligible class members may file a claim for up to $7,000 per person for out-of-pocket losses that are supported by documentation and “fairly traceable” to the data breach.
In addition, the document shares that class members may submit a claim for up to five hours of lost time spent handling issues related to the incident, at a rate of $25 per hour, and capped at $125 per person.
Alternatively, a class member may file a claim for a pro-rated cash payment in lieu of the aforementioned benefits, the agreement relays.
Furthermore, the deal will provide class members with the option to enroll in up to three years of credit monitoring and identity theft protection services, benefits available to all individuals regardless of whether they opt for a cash payment or reimbursement of out-of-pocket costs and/or lost time, the document explains.
The settlement agreement notes that all payments are subject to increase or decrease on a pro rata basis.
Notice of the settlement will be issued by mail within 30 days of the deal’s preliminary approval, the document says. Class members will have 90 days, beginning on the date of mailing, to file their Mondelēz and BCLP settlement claim forms, which can be submitted by mail or through the official settlement website once it is established.

According to the class action lawsuits against Mondelēz and BCLP, after the law firm detected unusual activity in its IT network on February 27, 2023, a subsequent investigation revealed that an unauthorized third party had accessed the systems, compromising certain files related to BCLP clients.
The data breach lawsuits alleged that the companies failed to prevent the cyberattack, which exposed, in Mondelēz’s case, the highly sensitive information of current and former employees, including names, dates of birth, Social Security numbers, addresses and employee identification numbers.
