POM Recoveries, Inc. is the defendant in a proposed class action that claims it sent debt collection letters that failed to comply with the requirements set forth in the Fair Debt Collection Practices Act (FDCPA). The letter allegedly notified the plaintiff that she could send a written dispute in order to obtain verification of the purported debt, but failed to differentiate between her right to dispute and her right to obtain verification, in violation of the FDCPA. The suit also claims that the letter further hindered the plaintiff’s ability to pay off the alleged debt by neglecting to clearly identify her creditor.
