Two representatives of a deceased Wisconsin woman’s estate have filed a proposed class action against Sentry Credit, Inc. and Midland Funding, LLC over alleged violations of both the Fair Debt Collection Practices Act (FDCPA) and the Wisconsin Consumer Act. According to the plaintiffs, the defendants sent a collection notice that implied “interest” and “other costs” could be added to the debt amount in the future. These “other costs”—which the case says could not by law be added by the defendants—are not explained anywhere in the collection notice, the lawsuit claims, and implying so constitutes an FDCPA violation.
