A proposed class action has been filed against North Broward Radiologists, P.A. over suspected Telephone Consumer Protection Act (TCPA) violations. The plaintiff claims the defendant, a certified group of diagnostic imaging physicians, has sent unsolicited text messages to consumers’ cell phones without first obtaining consent to do so.
According to the complaint, the plaintiff received automated text messages from the defendant on at least four occasions between April and May 2018. The texts supposedly informed the plaintiff that she could review her account or pay a bill online.
“At no point in time did [the plaintiff] provide [the defendant] with her cellular telephone number,” the suit asserts, pointing out the plaintiff is not now nor has ever been a client or patient of the defendants.
The lawsuit later alleges the inclusion of opt-out instructions in the texts indicate they were sent via an automatic telephone dialing system.
