According to the 21-page lawsuit, the popular video streaming service has violated a federal privacy law by knowingly embedding into Vudu.com and its apps tracking technology that discloses users’ video-viewing behavior, viewing histories and personally identifying data to unauthorized third parties.
Per the suit, the invisible tracking tools—which include Facebook’s Meta pixel and Conversions application programming interface (API), Google Analytics and more—automatically capture and record subscribers’ interactions with the website and apps without user knowledge.
The case alleges that when a subscriber uses the platform, these tracking codes intercept and transmit to the third parties the title and URL of any videos the consumer views, and their Facebook ID—a unique identifier linked to an individual’s Facebook profile.
Importantly, by disclosing a user’s Facebook ID, the platform thereby provides enough data to pinpoint a subscriber’s identity and connect it to their viewing behavior and history, the complaint shares.
The filing contends that at no point does the company inform users that their data is tracked and shared with third parties, nor does the platform obtain consent before disclosing the private information.
The plaintiff, a Vudu subscriber residing in California, says he often watches video content on the platform. By doing so, the man’s personal information was captured and shared with third parties, in violation of his protected privacy rights, the case charges.
The lawsuit looks to represent anyone in the United States who logged into Vudu.com or the platform’s apps and viewed prerecorded content using their mobile or computer browsers.
