A proposed class action filed against East Coast Polytechnic Institute (ECPI University) claims the defendant placed unlawful calls and texts to consumers’ cell phones without their express consent. The plaintiff in the case, a California resident, cites at least 11 occasions on which he supposedly received automated text messages to his cell phone attempting to market the school’s culinary program. Prior to the texts, the defendant allegedly left a voicemail on the man’s phone for the same purpose that was supposedly placed using prohibited autodialing technology. According to the case, the plaintiff never provided the defendant with his consent to receive the texts or call and never had a prior business relationship with ECPI.
