A Florida consumer is the plaintiff in a proposed class action that alleges Capital One, N.A. ran afoul of the Telephone Consumer Protection Act (TCPA) when it used an automatic telephone dialing system to place non-emergency calls to consumers cell phones without consent. The complaint specifically claims that Capital One placed unwanted robocalls to wrong or reassigned cell phone numbers that did not belong to its customers.
