Encore Capital Group, Inc. is facing a California man’s claims that the company placed 24 unlawful robocalls to his cell phone without his prior consent.
Encore Capital Group, Inc. is facing a California man’s claims that the company placed 24 unlawful robocalls to his cell phone without his prior consent. In a proposed class action lawsuit, the plaintiff alleges that his American Express card was switched over to Visa when Costco “changed credit cards,” making the defendant his new creditor. The case claims the debt collector used automated dialing technology to place 24 calls to the man’s cell phone between September 19, 2017 and October 2, 2017, sometimes multiple times in one day and even more than once in the same hour. According to the complaint, the plaintiff never provided the defendant his consent to receive the calls, which were made for non-emergency purposes and caused the plaintiff to become “frustrated and distressed” that his privacy was being invaded.
