The 18-page lawsuit was filed after the United States Department of Agriculture’s Food Safety and Inspection Service (FSIS) announced on October 9 that it had detected the harmful bacteria in food products containing BrucePac’s precooked meat—specifically, its ready-to-eat chicken.
According to the FSIS’s report, the recalled products include ready-to-eat meat and poultry items produced between May 31, 2024 and October 8, 2024, which, per the case, were subsequently incorporated into pre-packaged foods such as salads, sandwiches and frozen meals sold nationwide at grocery chains including Walmart, Kroger and Trader Joe’s.
The class action suit claims BrucePac has failed to warn consumers that its products may be contaminated with Listeria, a type of bacteria that can cause a serious infection called listeriosis. Per the complaint, this dangerous foodborne illness can trigger muscle aches, headaches, fever, nausea, diarrhea, confusion, loss of balance, convulsions and other health concerns, and is particularly harmful to pregnant women, elderly adults and people who are immunocompromised.
The plaintiff, a South Carolina resident, says he suffered diarrhea and other gastrointestinal issues after he bought and consumed a Marketside-brand Caesar salad with chicken from Walmart in August of this year.
Consumers like the plaintiff expect the food products they purchase to be safe, the filing contends, arguing that they would not have bought items containing BrucePac’s ready-to-eat poultry had they known of the risk of Listeria exposure.
The BrucePac Listeria recall lawsuit looks to represent anyone in the United States who purchased ready-to-eat foods that contained the company’s precooked meat and poultry products contaminated with Listeria during the applicable statute of limitations period.
