Bosch Dishwasher Lawsuit Says Control Panel Label Fading Renders Appliances Unusable

A proposed class action lawsuit alleges certain Bosch dishwashers are made with defective control panel labeling that fades relatively soon after purchase, leaving the appliances “impossible, or at least unreasonably difficult,” to use.

The 18-page Bosch class action lawsuit claims BSH Home Appliances Corp.’s 100-, 300-, 500- and 800-Series Bosch dishwashers are “defectively designed” given that their control panel labeling fades far too quickly. The Bosch dishwashers’ control panel labeling includes numerous settings and buttons that “are not intuitive to use,” the filing says, and the faded lettering leaves the appliances unfit for their intended purpose of washing dishes, the complaint argues.
According to the suit, BSH is aware that the Bosch dishwasher label fading problem is “widespread” yet has failed to provide repairs for the defect under warranty or attempt to fix the issue. At the same time, Bosch “does not disclose the defect to prospective customers,” the lawsuit alleges.
As the case tells it, the lettering can prematurely fade even on floor room model Bosch dishwashers that have never been used.
“Reasonable consumers expect that when they splurge on a high-priced Bosch dishwasher (which can easily cost over $1000), it not only looks good, but can perform its basic functions as intended,” the suit emphasizes. “However, despite their high price, Bosch-brand dishwashers suffer from a common defect which renders them unfit for their intended purpose.”
The Bosch lawsuit stresses that since consumers interface with their dishwashers primarily through the control panel, the control panel and display are critical to the use and safety of the appliances. For the 100-, 300-, 500- and 800-Series Bosch dishwashers at issue, there has been an “unusually high” number of complaints from consumers, the case notes.
The complaint goes on to contend that Bosch’s one-year limited warranty for the 100-, 300-, 500- and 800-Series Bosch dishwashers “fails of its essential purpose” since the company does not disclose its knowledge of the control panel fading defect or provide control panel lettering replacements under warranty.
In addition, Bosch breached its product warranty when it shipped to consumers dishwashers that were “defective when they came off the assembly line,” the filing claims.
“Further, because Bosch does not have non-defective dishwashers available to replace the defective dishwashers, and because its repairs (if any) are simply a band-aid that do not resolve the defect, it is unable to fulfill its warranty obligations at the point of purchase, or anytime thereafter, and the warranty is therefore breached immediately upon purchase.”
The Bosch class action looks to cover all consumers in the United States who bought a 100-, 300-, 500- or 800-Series Bosch dishwasher for personal or household use in the last four years.
