A Florida resident has filed suit against American Insurance Agencies Direct Holding, Inc. claiming the insurance company violated the Telephone Consumer Protection Act by sending him a text message advertisement without his prior consent.

A Florida resident has filed suit against American Insurance Agencies Direct Holding, Inc. claiming the insurance company violated the Telephone Consumer Protection Act by sending him a text message advertisement without his prior consent. The plaintiff allegedly received the following text from the defendant:
“Quality Affordable Health Insurance. Choice of Drs and Hospitals. Save up to 30%. Call me! Reply STOP to prevent further messages."
According to the suit, the plaintiff replied with “stop” and then received another message informing him he had “successfully been unsubscribed.” The man claims he had no prior business relationship with the defendant and had never expressed an interest in its services or provided consent to receive text messages, which he says were sent via an automated dialing system.
