Air Methods faces a class action after a November 2023 data breach exposed the private information of approximately 34,000 current and former patients.

A $240,000 settlement has been reached to resolve a proposed class action lawsuit that alleged negligence on the part of medical helicopter company Air Methods resulted in a November 2023 data breach that impacted more than 24,000 people.

The $240,000 deal covers a class of 24,568 individuals who received direct notice that their personal information may have been implicated in the November 2023 security incident, in which a laptop possibly containing sensitive patient data was stolen from the company’s billing office, the Air Methods class action lawsuit relayed.
To receive Air Methods settlement benefits, class members must submit a valid claim form online or by mail by December 11, 2024.

As part of the deal with Air Methods, eligible class members can file a claim for up to $2,500 per person for documented out-of-pocket losses that were incurred between November 9, 2023 and December 11, 2024 and are “reasonably traceable” to the data breach, the settlement website says.
In addition, consumers may submit a claim for a pro-rated cash payout estimated to be $75, the site shares.
The aforementioned cash benefits may increase or decrease depending on the total number of valid claims that are submitted, the website notes.
Finally, the Air Methods settlement will provide two years of complimentary identity theft protection and credit monitoring services to class members who file a claim, the site states.
The deal was preliminarily approved by the court on August 13, 2024. The parties now await a hearing set for January 10, 2025, at which the court will decide whether to grant final approval to the terms of the Air Methods settlement.
The website relays that settlement benefits will be issued only if the court ultimately approves the deal, and after any appeals are resolved.
