“The amount of the payments to individual Settlement Class Members will depend on the number of valid claims that are filed,” the settlement site says. “Because the final payment amount cannot be calculated before all claims are received and verified, it will not be possible to provide an accurate estimate of the payment amount before the deadline to file claims.”
The Gaia class action settlement was preliminarily approved by the court in July 2024. A final approval hearing is scheduled for December 9 of this year.
According to the site, class members should expect to receive their cash payout within 90 days after the deal is granted final approval from the court and any appeals are resolved.
Filed in September 2022, the initial Gaia lawsuit claimed the company violated the federal Video Privacy Protection Act (VPPA) by disclosing subscribers’ personally identifiable information, including a record of every video they watch on Gaia.com and YogaInternational.com, to Facebook without consent. The case alleged that consumers’ data was captured and shared with the social media giant using an invisible piece of code called the Facebook tracking pixel.
As part of the settlement, Gaia has agreed to stop using the Facebook pixel on its websites to ensure its compliance with the VPPA.
