- The dark spots which form on Portico decking products are unable to be cleaned, consumers have alleged. In the best case scenario, cleaning methods recommended by the manufacturer work in part, but soon thereafter, the fungal growth reappears as badly as or worse than before.
If you purchased Portico Series Decking products and noticed dark spotting on your deck, you may be entitled to compensation. It has been alleged that Fiberon, the manufacturer of Portico decking products, sold a product that was inherently defective, and has failed to honor its warranty obligations when consumers submitted claims for these spots. The dark, gray or leopard-like spots are believed to be the manifestation of mold, mildew or other fungal growth.
Portico Decking Problems
Portico decking cleaning methods don't help spots, consumers claim.
A Portico class action complaint alleges that these decking products, including Portico Advantage, contain a uniform latent defect. This defect manifests as dark spotting throughout the surface of the deck - the result of mold, mildew of other fungal growth, the suit claims. It has been alleged that this uniform spotting pattern develops even if the product was properly installed, maintained and cleaned. Furthermore, these Portico decking problems recur after being cleaned and cannot be prevented or remediated, according to the suit.
According to the Portico decking class action complaint, Fiberon expressly warranted its decking products for 20 years but has uniformly rejected claims under this warranty. It has been alleged that the company has refused to pay for cleaning costs; failed to replace the spotted decking material; and refused to cover the expense of replacement labor costs to remove the boards and install new ones. In response to Portico decking complaints, the manufacturer has allegedly advised consumers to clean their decks at their own expense with chemical products which do little to help the spotting. At best, the cleaning methods work in part, only for the fungal growth to return as badly as or worse than before, according to allegations.
Portico Decking Complaints
If you have Portico decking complaints regarding spotting, fungal growth or discoloration, you may have legal recourse. The company represented that the Portico Series Decking products were superior to natural wood products, which can fade or mold and need to be treated and sealed regularly, charging a premium price for these benefits. It has been alleged, however, that the Portico Series Decking products are defective, and have caused consumers great expense to clean, repair or replace the boards, which were nearly twice the cost of natural wood products.
