Class Action Lawsuit Claims Nespresso Vertuo Next Coffee Machines Are ‘Notoriously Defective’

According to the 61-page Nespresso lawsuit, the apparent leakage defect renders the machine incapable of retaining the water used to brew coffee, impeding or wholly preventing successful coffee production. The suit contends that the company has misled consumers about the quality and functionality of its “notoriously defective” product, which can allegedly develop serious water leakages and become unusable after months or even days of normal use.
Since releasing the Vertuo Next model in 2020, Nespresso has touted the product as an eco-friendly device purportedly made of 54 percent recycled plastic, the case says. The emphasis on sustainability is meant to entice eco-conscious consumers willing to pay a premium price for products that are ostensibly environmentally friendly, the complaint asserts.
However, the filing calls these marketing tactics deceptive, arguing that “Nespresso’s claims of environmental sustainability are belied by its practice of making defective coffee brewers that are relegated to landfills shortly after purchase.”
In the years since the coffee machine’s market debut, consumers have posted an “avalanche of complaints” online, where the consensus is that the products are “defective, failure-prone machines that should be avoided at all costs,” the lawsuit claims.
In spite of widespread customer complaints, Nespresso has never publicly acknowledged or adequately remedied the alleged defect, the suit claims. The company has failed to fix the issue during the one-year limited warranty period and “routinely refuses” to replace or repair the product free of charge after the warranty expires, the filing asserts.
The lawsuit contends that consumers have been deceived and overcharged as a result of Nespresso’s unfair and misleading conduct. The case argues that Nespresso customers, who bought the device for anywhere between $179 and $209 with the belief that it was a high-quality, eco-friendly product, would not have paid as much or purchased it at all had they known the coffee machine was allegedly defective.
The lawsuit looks to represent all United States residents who, during the applicable statute of limitations period, purchased a Nespresso Vertuo Next coffee machine that experienced the leakage defect, for which they did not receive a replacement from Nespresso or, if they received a replacement, the replacement also experienced the defect.
