- Type of Lawsuit
- Mass Tort
Approved to prevent against certain strains of HPV in males and females between the ages of 9 and 26, Gardasil has been linked to a number of serious side effects. More than 8000 complaints of adverse side effects have been reported, with as many as 51 deaths among the reports. While the number of injuries from Gardasil reactions has been relatively low, several high profile cases, mostly involving paralysis and death, have increased public awareness of the potential risks.
Side Effects: Paralysis, Coma
The following are among the alleged problems experienced by those injected with the Gardasil HPV vaccine:
- Seizures
- Paralysis
- Guillain-Barre Syndrome
- Coma
- Bells palsy
- Blood clots
- Anaphylactic shock
- Spontaneous abortion
- Death
While there is no definitive link between these side effects and Gardasil, some doctors have begun to take notice of the HPV vaccine’s risks, with certain physicians stating that Gardasil, if used, should be limited to women who have reached the age of maturity. No link between age and Gardasil reactions, however, has been reported.
Deaths
As of Feb. 14, 2011, the CDC has reported that there have been 51 reports of deaths among females who received the HPV vaccine. A total of 32 of these death reports have been confirmed, meaning that a doctor has reviewed the report and any associated records. There have been two reports of deaths among males who were injected with Gardasil. The CDC maintains, however, that there was no unusual pattern or clustering to the deaths which would suggest that they were caused by the HPV vaccine.
Filing a Lawsuit
As the CDC and FDA continue to monitor for potential Gardasil risks, several lawsuits have been filed against the HPV vaccine’s manufacturer, Merck, alleging paralysis, heart palpitations and death, among other problems. Because the drug manufacturer is required to ensure the safety and efficacy of their products, or at the very least warn of potential dangers, young women and men who suffered from serious side effects may be able to participate in a similar legal action.
