According to the class action complaint, the coffeemaker contains a design defect which was actively concealed by the manufacturer. The plaintiff in the case claims that when she tried to pour coffee from the pot, the handle broke away from the glass carafe, which broke as a result and caused hot coffee to spill. She attempted to repair the carafe to fix her Black and Decker Spacemaker Coffeemaker problems, but the coffeemaker did not function as represented, the suit claims. Allegedly, the manufacturer sent consumers replacement carafes which were also defective, did not work or were in poor condition. Furthermore, the lawsuit claims that defendant Applica Consumer Products Inc. fails to honor its warranty to fix the defect or reimburse the consumer for the cost of their product and provides a toll-free helpline which provides little assistance to the consumer who is often forced to wait on the line for extended periods of time.
