Lawsuits have been filed alleging that the shingles crack, blister and otherwise wear out far before they should – and that Atlas Corp. should be responsible for the money homeowners have laid out to fix their roofs. What Do the Lawsuits Say?
Lawsuits claim that the Atlas’ Chalet shingles were defectively designed and manufactured. Specifically, the suits claim that the shingles allow in moisture (i.e., rain and snow), which ultimately creates gas bubbles that cause the shingles to blister, crack, lose granules and eventually fail. This can cause damage to the underlying home.
Consumers have claimed that they had to replace their roofs to prevent further damage and have found little help from Atlas. It has been alleged that it is Atlas’ policy to blame the issue on the homeowner or otherwise improperly deny warranty claims. One suit claims some warranty claims were purposely miscoded as being related to other problems, such as “weight,” in an attempt to mask the widespread nature of the alleged defect.
Even worse, lawsuits claim Atlas received complaints about the quality of the shingles as far back as 1999, with thousands lodged in the 2000s. Still, Atlas never recalled the Chalet shingles and continued to sell them until 2010.
Is This a Class Action?
The lawsuits being filed against Atlas are individual lawsuits – and not class actions. This means you will need to hire your own attorney and file your own case to have a chance at getting money back for your roof repairs and/or replacement.
I Thought There Was a Class Action Suit…
There was. Unfortunately, in May of 2017, a judge handed down a ruling that essentially put an end to the litigation – at least as a class action.
Attorneys working with ClassAction.org believe that they have enough evidence, including an internal company document referring to a possible defect in the shingles, to continue the fight against Atlas. They are currently filing these lawsuits on an individual basis. The shingles were reportedly sold to approximately 125,000 people, and attorneys suspect the manufacturer will not want to defend potentially thousands of individual lawsuits.
