Kaiser Foundation Health Plan Data Breach:
Lawsuit Investigation
Attorneys working with ClassAction.org are looking into whether a class action lawsuit can be filed in light of the Kaiser Foundation Health Plan data breach.
As part of their investigation, they need to hear from individuals who received a notice stating they were impacted.
On April 12, 2024, Kaiser Foundation Health Plan, Inc., which provides health insurance plans to employers, reported to the U.S. Department of Health and Human Services (HHS) a data breach affecting 13,400,000 individuals.
TechCrunch reports that the company will be notifying "millions of current and former members" of the breach, which involved the sharing of patient data with third-party advertisers including Microsoft, Google and X via tracking tools. According to the article, the compromised data may include member names, IP addresses and how members interacted with the company's websites and mobile apps.
Companies that are covered by the Health Insurance Portability and Accountability Act (HIPAA) are required to report data breaches involving protected health information to affected individuals and the Secretary of Health and Human Services.
Consumer notices are reportedly expected to be sent out beginning in May.
If your information was exposed in the breach, attorneys want to hear from you. You may be able to start a class action lawsuit to recover compensation for loss of privacy, time spent dealing with the breach, out-of-pocket costs, and more.
A successful case could also force Kaiser Foundation Health Plan to ensure it takes proper steps to protect the information it was entrusted with.
